Zusammenfassung Hintergrund Advance Care Planning (ACP) wird auch in Deutschland zunehmend praktiziert. Aus klinisch-ethischer Perspektive bietet ACP eine Möglichkeit, Vorausverfügungen zu konkretisieren und auf diese Weise die Entscheidungsfindung bei fehlender Selbstbestimmungsfähigkeit von Patient:innen zu unterstützen. Während es für Gesprächsangebote im Sinne des ACP in Pflegeeinrichtungen und Einrichtungen der Eingliederungshilfe seit 2015 Finanzierungsmöglichkeiten gibt und erste Studien zu Angeboten veröffentlich wurden, fehlt es in Deutschland bisher an publizierten Evaluationsstudien zu ACP-Angeboten im Krankenhaus. Intervention und Methoden Im vorliegenden Beitrag erfolgt die strukturierte (...) Darstellung von ACP als ein Element des klinisch-ethischen Unterstützungsangebotes am Universitätsklinikum Halle (Saale) (UKH). Es erfolgte eine quantitative Inhaltsanalyse der schriftlichen Dokumentation von durchgeführten ACP-Gesprächsprozessen für den Zeitraum der Pilotphase von 01/2020 bis 08/2021 (20 Monate). Ergebnisse Im Zeitraum wurden 93 ACP-Gespräche angefragt. Mit 79 Patient:innen konnten 110 Gespräche geführt werden. 46 % der Anfragen kamen von Palliative Care betreuten Patient:innen. Im Durchschnitt dauerten die Beratungen 45 min. Der Gesprächsprozess zur Erstellung einer Patientenverfügung benötigte durchschnittlich 122 min und 2,5 Gespräche. Bei 23 % der Patient:innen endete der ACP-Prozess nach dem Erstgespräch. Die Inhalte der ACP-Prozesse tangierten verschiedene Bereiche anderer Professionen im Krankenhaus, insbesondere die Entscheidungsfindung über aktuelle Diagnostik und Therapie zwischen Ärzt:innen und Patient:innen. Diskussion Die Einführung eines ACP-Angebotes im Krankenhaus zeigt neben einer Vielzahl an Chancen auch Herausforderungen auf, welche es im gemeinsamen Diskurs zu bewältigen gilt. Bei der Einbettung eines ACP-Angebots im Krankenhaus müssen die Besonderheiten der Klinik und insbesondere die Abgrenzung von ACP zu anderen Arbeitsfeldern der Ethikberatung, wie beispielsweise die Ethikfallberatung, bedacht werden. BackgroundClinical ethics case consultations (CECCs) provide a structured approach in situations of ethical uncertainty or conflicts. There have been increasing calls in recent years to assess the quality of CECCs by means of empirical research. This study provides detailed data of a descriptive quantitative and qualitative evaluation of a CECC service in a department of cardiology and intensive care at a German university hospital.MethodsSemi-structured document analysis of CECCs was conducted in the period of November 1, 2018, to May 31, 2020. All documents were analysed by two researchers independently.ResultsTwenty-four CECCs were requested within the study period, of which most (n = 22; 92%) had been initiated by physicians of the department. The patients were an average of 79 years old (R: 43–96), and 14 (58%) patients were female. The median length of stay prior to request was 12.5 days (R: 1–65 days). The most frequent diagnoses (several diagnoses possible) were cardiology-related (n = 29), followed by sepsis (n = 11) and cancer (n = 6). Twenty patients lacked decisional capacity. The main reason for a CECC request was uncertainty about the balancing of potential benefit and harm related to the medically indicated treatment (n = 18). Further reasons included differing views regarding the best individual treatment option between health professionals and patients (n = 3) or between different team members (n = 3). Consensus between participants could be reached in 18 (75%) consultations. The implementation of a disease specific treatment intervention was recommended in five cases. Palliative care and limitation of further disease specific interventions was recommended in 12 cases.ConclusionsTo the best of our knowledge, this is the first in-depth evaluation of a CECC service set up for an academic department of cardiology and intensive medical care. Patient characteristics and the issues deliberated during CECC provide a starting point for the development and testing of more tailored clinical ethics support services and research on CECC outcomes. Philip Kitcher’s The Ethical Project trios to vindicates ethics through an analysis of its evolutionary and cultural history, a history which in turn, he thinks, supports a particular conception of the role of moral thinking and normative practices in human social life. As Kitcher sees it, that role could hardly be more central: most of what makes human life human, and preferable to the fraught and impoverished societies of the great apes, depends on moral cognition. Prom this view of (...) the role of the ethical project as a social technology, Kitcher derives an account of moral progress and even moral truth: a normative analogue of the idea that truth is the convergence of rational enquiry. To Kitcher’s history, I present an anti-history. Most of what is good about human social life depends on the expansion of our social emotions, not on our capacities to articulate and internalise explicit norms. Indeed, since the Holocene and the origins of complex society, normative thought and normative institutions have been more prominent as tools of exploitation and oppression than as mechanisms of a social peace that balances individual desire with collective co-operation. I argue that the vindication project fails in its own terms: even given Kitcher’s distinctive pragmatic concept of vindication, history debunks rather than vindicates moral cognition. (shrink)

Imitation has been understood in different ways: as a cognitive adaptation subtended by genetically specified cognitive mechanisms; as an aspect of domain general human cognition. The second option has been advanced by Cecilia Heyes who treats imitation as an instance of associative learning. Her argument is part of a deflationary treatment of the “mirror neuron” phenomenon. I agree with Heyes about mirror neurons but argue that Kim Sterelny has provided the tools to provide a better account of the nature and (...) role of human imitation. What we call imitative learning is an instance of social learning. It has little to do with empathy, emotional contagion, or mind reading. (shrink)

Confucianism and Catholicism are among the most influential religious traditions and share a long and intricate relationship. Beginning with the work of Matteo Ricci, the nature of this relationship has sometimes generated great debate, which is still alive today. The ten essays in this volume continue and advance this long conversation. Written by specialists in both traditions, the essays are organized into two groups. Those in the first group focus primarily on the historical and cultural contexts in which Confucianism and (...) Catholicism encountered one another in the four major Confucian cultures of East Asia. These essays seek to understand specific figures, texts, and issues in light of those broader contexts. Allegedly, irreducible mental properties can be causally relevant in virtue of figuring in non-redundant program explanations which convey information not conveyed by explanations in terms of the physical properties that actually do the ‘causal work’. I argue that none of the possible ways to spell out the intuitively plausible idea of a program explanation serves its purpose, viz., defends non-reductive physicalism (...) against Jaegwon Kim’s Causal Exclusion Argument according to which non-reductive physicalism is committed to epiphenomenalism because irreducible mental properties are ‘screened off’ from causal relevance by their physical realizers. Jackson and Pettit’s most promising explication of a program explanation appeals to the idea of invariance of effect under variation of realization , but I show that invariance of effect under variation of realization is neither necessary nor sufficient for causal relevance. In a recent article, Kim Sterelny and Philip Kitcher5 defend a version of genic selectionism and attempt to refute the criticisms I made of that doctrine. Their defense has two components. First, they find fault with the account I gave of the units-of-selection controversy-an account which uses the idea of probabilistic causality as a tool of explication. Second, they provide a positive account of their own of what that controversy concerns, one which they think allows genic selectionism to emerge (...) as a successful thesis. I believe that the position they sketch is mistaken, both in its general orientation and in its details. I believe that the Sterelny/ Kitcher position misunderstands what the biological question of the units of selection is about and that their criticisms of my own proposal are mistaken as well. In an important article, Kim Sterelny and Philip Kitcher challenge the common assumption that for any biological phenomenon requiring a selectionist explanation, it is possible to identify a uniquely correct account of the relevant selection process. They argue that selection events can be modeled in any of a number of different, equally correct ways. They call their view ' Pluralism,' and explicitly connect it with various antirealist positions in the philosophy of science. I critically evaluate Sterelny and Kitcher's Pluralism (...) along with its attendant antirealist theses. In particular, I argue that there are serious problems with their pluralistic antirealism regarding units of selection. By correctly diagnosing these problems a more adequate position can be constructed. I defend such a position, which I designate Inclusive Hierarchical Monism, and show how it captures the important virtues of Sterelny and Kitcher's approach while avoiding its problems. (shrink)

This paper explores principles governing the rational balance among an agent's beliefs, goals, actions, and intentions. Such principles provide specifications for artificial agents, and approximate a theory of human action (as philosophers use the term). By making explicit the conditions under which an agent can drop his goals, i.e., by specifying how the agent is committed to his goals, the formalism captures a number of important properties of intention. Specifically, the formalism provides analyses for Bratman's three characteristic functional roles played (...) by intentions [7, 9], and shows how agents can avoid intending all the foreseen side-effects of what they actually intend. Finally, the analysis shows how intentions can be adopted relative to a background of relevant beliefs and other intentions or goals. By relativizing one agent's intentions in terms of beliefs about another agent's intentions (or beliefs'), we derive a preliminary account of interpersonal commitments. (shrink)

This study uses conversation analysis to investigate how participants in Korean conversations negotiate their epistemic rights to information by deploying alternate evidential markers. The participants mutually monitor each other’s different or changing epistemic rights to the information and routinely shift their choice of evidential markers to —tamye to redistribute their epistemic rights. By manipulating the turn-taking and sequence organizations which underlie the —tamye evidential marker, the participants can claim or downgrade their epistemic rights to the information. The findings of this (...) study contribute to research on evidentiality by providing an interactional perspective which takes the orientation of the participants in actual interactions as the starting point of analysis. The study illustrates how evidential markers serve to negotiate the relationships among the speaker, the hearer, and the information in the course of the interaction rather than merely function to reflect an implicit contract or territory between the speaker’s and the hearer’s information. Arendt Contra Sociology re-assesses the relationship between Hannah Arendt's work and the theoretical foundations of sociology, bringing her insights to bear on key themes within contemporary theoretical sociology. Departing from the view of Arendt as a political theorist who sought to rescue politics from society, and political theory from the social sciences, this book re-examines her distinctions between labour, fabrication and action as a theory of the fundamental ontology of human societies, revisiting her criticism of the tendency of many sociological (...) paradigms to conflate the activity of fabrication with that of action. In the Nicomachean Ethics, one of Aristotle’s most frequent characterizations of the virtuous agent is that she acts for the sake of the fine (to kalon). In IX.8, this pursuit of the fine receives a more specific description; virtuous agents maximally assign the fine to themselves. In this paper, I answer the question of how we are to understand the fine as individually and maximally acquirable. I analyze Nicomachean Ethics IX.7, where Aristotle highlights virtuous activity (energeia) as central to the (...) fine, and argue that when virtuous agents pursue the fine, what they are pursuing is virtuous activity. I then address various problems, like how virtuous people can maximize virtuous activity yet sacrifice their lives, which would seem to amount to sacrificing future opportunities to virtuous activity and therefore not maximizing it. I also eliminate alternative interpretations that do not take virtuous activity as necessary to the fine, for example the common good interpretation, whereby virtuous agents pursuing the fine amounts to their pursuing the common good. Frank Jackson, Philip Pettit, and Jaegwon Kim put forward two models of higher-level causal explanation. Advocates of both versions are inclined to draw the conclusion that the models don't differ substantially. I argue, on the contrary, that there are relevant metaphysical differences between Jackson and Pettit's notion of programme explanation on the one hand, and Kim's idea of supervenient causation on the other. These can be traced back to underlying differences between the contents of their physicalisms.

This paper criticizes the circularity reading of Frege's argument for the indefinability of truth. According to this reading, Frege is appealing to a sort of circularity in the argument. I argue that the circularity reading is interpretatively incorrect, or makes Frege's argument a non‐starter.

There is a very striking difference between even the simplest ethnographically known human societies and those of the chimps and bonobos. Chimp and bonobo societies are closed societies: with the exception of adolescent females who disperse from their natal group and join a nearby group (never to return to their group of origin), a pan residential group is the whole social world of the agents who make it up. That is not true of forager bands, which have fluid memberships, and (...) regular associations with neighbouring bands. They are components of a larger social world. The open and fluid character of forager bands brings with it many advantages, so the stability of this more vertically complex form of social life is not difficult to explain, once it establishes. But how did it establish, if, as is likely, earlier hominin social worlds resemble those of our close pan relatives in the suspicion (even hostility) of one band to another? How did hominin social organisation transition from life in closed bands, each distrustful of its neighbours, to the much more open social lives of foragers? I will discuss and synthesise two approaches to this problem, one ecological, based on the work of Robert Layton and his colleagues, and another that is organised around an expansion of kin recognition, an idea primarily driven by Bernard Chapais. The paper closes by discussing potential archaeological signatures both of more open social worlds, and of the supposed causal drivers of such worlds. (shrink)

Surprisingly little is known about what ancient Confucian thinkers struggled with in their own social and political contexts and how these struggles contributed to the establishment and further development of classical Confucian political theory. Leading scholar of comparative political theory, Sungmoon Kim offers a systematic philosophical account of the political theories of Mencius and Xunzi, investigating both their agreements and disagreements as the champions of the Confucian Way against the backdrop of the prevailing realpolitik of the late Warring States period. Together, they contributed to the formation of Confucian virtue politics, in which concerns about political order and stability and concerns about moral character and moral enhancement are deeply intertwined. By presenting their political philosophies in terms of constitutionalism, Kim shows how they each developed the ability to authorize the ruler's legitimate use of power in domestic and interstate politics in ways consistent with their distinctive accounts of human nature. Do citizens have an obligation to obey the law? This book differs from standard approaches by shifting from the language of obedience to that of deference. The popular view that law claims authority but does not have it is here reversed on both counts: law does not claim authority but has it. Though the focus is on political obligation, the author approaches that issue indirectly by first developing a more general account of when deference is due to the view of (...) others. Two standard practices that political theorists often consider in exploring the question of political obligation - fair-play and promise-keeping - can themselves be seen as examples of a duty of deference. In this respect the book defends a more general theory of ethics whose scope extends beyond the question of political obligation to questions of duty in the case of law, promises, fair play and friendship. Common sense and philosophical tradition agree that mind makes a difference. What we do depends not only on how our bodies are put together, but also on what we think. Explaining how mind can make a difference has proved challenging, however. Some have urged that the project faces an insurmountable dilemma: either we concede that mentalistic explanations of behavior have only a pragmatic standing or we abandon our conception of the physical domain as causally autonomous. Although each option has its (...) advocates, most theorists have sought a middle way that accommodates both the common-sense view of mind and the metaphysical conviction about the physical world. In seeking an answer to the question, How can the church speak from Christian warrants on any of the fateful choices we face in our common life, Paul Ramsey argued that, when it speaks, the voice of the church ought to be instructional rather than advocatory. An investigation of what the Episcopal Church has said over the past 20 years about abortion provides strong support for Ramsey's argument. This history suggests also that additional questions need to be asked if that (...) church and others are to address adequately the issues raised by the decision of the Supreme Court in the case of Webster v. Reproductive Health Services. The most important of these questions are: (a) on what sorts of issues are the churches obliged to speak, (b) are these issues ones that call for agreement, (c) to whom are the churches obliged to speak, (d) in what vocabulary ought they to speak, (e) who ought to speak, and (f ) under what circumstances is anyone obliged to listen. At a minimum, an adequate ethic for ecclesiastical pronouncements requires that these questions be asked and answered. (shrink)

Over forty years ago, the American philosopher and educationalist began work on what was to become a series of philosophical novels for children. As time went on, he also constructed accompanying teacher resources together with colleagues. The most popular of these works were designed for primary education and constitute what came to be known as the IAPC Curriculum for the younger years. The influence of Lipman has been immense. He taught us that philosophy is not beyond the reach of primary (...) school children when appropriately presented; that the questions of philosophy are germane to all primary school subjects; and that philosophy can be used to encourage thinking across the curriculum. Influential and instructive as these materials have been, however, they do not constitute a curriculum in the sense in which that is generally understood in school education. This paper explores both the strengths and limitations of Lipman’s pioneering effort from the viewpoint of curriculum construction in order to see what lessons can be leaned. (shrink)

We present the first neurophysiological signatures showing distinctive effects of group social context and emotional arousal on cultural perceptions, such as the efficacy of religious rituals. Using a novel protocol, EEG data were simultaneously recorded from ethnic Chinese religious believers in group and individual settings as they rated the perceived efficacy of low, medium, and high arousal spirit-medium rituals presented as video clips. Neural oscillatory patterns were then analyzed for these perceptual judgements, categorized as low, medium, and high efficacy. The (...) results revealed distinct neural signatures and behavioral patterns between the experimental conditions. Arousal levels predicted ratings of ritual efficacy. Increased efficacy was marked by suppressed alpha and beta power, regardless of group or individual setting. In groups, efficacy ratings converged. Individual setting showed increased within-participant phase synchronization in alpha and beta bands, while group setting enhanced between-participant theta phase synchronization. This reflected group participants' orientation toward a common perspective and social coordination. These findings suggest that co-presence in groups leads to a social-tuning effect supported by between-participant theta phase synchrony. Together these neural synchrony patterns reveal how collective rituals have both individual and communal dimensions. The emotionality of spirit-medium rituals drives individual perceptions of efficacy, while co-presence in groups signals the significance of an event and socially tunes enhanced agreement in perceptual ratings. In other words, mass gatherings may foster social cohesion without necessarily requiring group-size scaling limitations of direct face-to-face interaction. This could have implications for the scaling computability of synchrony in large groups as well as for humanistic studies in areas such as symbolic interactionism. (shrink)

What is attention? How does it go wrong? Do attention deficits arise from genes or from the environment? Can we cure it with drugs or training? Are there disorders of attention other than deficit disorders? The past decade has seen a burgeoning of research on the subject of attention. This research has been facilitated by advances on several fronts: New methods are now available for viewing brain activity in real time, there is expanding information on the complexities of the biochemistry (...) of neural activity, individual genes can be isolated and their functions identified, analysis of the component processes included under the broad umbrella of "attention" has become increasingly sophisticated, and ingenious methods have been devised for measuring typical and atypical development of these processes, from infancy into childhood, and then into adulthood. In this book, Kim Cornish and John Wilding are concerned with attention and its development, both typical and atypical, particularly in disorders with a known genetic etiology or assumed genetic linkage.
